User Agreement
This user agreement ("Agreement") sets forth the terms and conditions governing the provision of services by On The Globe to individuals ("the User") intending to purchase or inquire about any products and/or services of On The Globe using On The Globe's websites or other customer interface channels. Both the User and On The Globe are individually referred to as a "party" to this Agreement and collectively as the "parties."
User's Acknowledgment
By availing services from On The Globe, the User acknowledges that they have read, understood, and expressly accepted the terms and conditions of this Agreement, which govern the desired transaction or provision of services by On The Globe for all purposes. All rights and liabilities of the User and/or On The Globe with respect to any services provided by On The Globe shall be subject to the terms of this Agreement.
On The Globe reserves the right, in its sole discretion, to terminate access to any or all On The Globe websites or other sales channels and related services, or any portion thereof, at any time and without notice, for general maintenance or any reason whatsoever.
Additional Terms of Service
In addition to this Agreement, specific terms of service (TOS) apply to certain services or products provided by On The Globe, such as air tickets, holiday packages, etc. These TOS will be provided or updated by On The Globe and shall be considered part of this Agreement. In the event of a conflict between such TOS and this Agreement, the terms of this Agreement shall prevail. The User must read and accept the relevant TOS for the service or product availed.
Third Party Account Information
By using the Account Access service on On The Globe's websites, the User authorizes On The Globe and its agents to access third-party sites, including those of banks and other payment gateways, designated by them or on their behalf for retrieving requested information. The User is responsible for maintaining the confidentiality of their password and account, and for all activities that occur while using their password or account.
Confidentiality
Any information specifically designated by On The Globe as confidential shall be maintained confidentially by the User and shall not be disclosed except as required by law or to fulfill the obligations of this Agreement.
Website and Mobile App Usage
The User acknowledges that their use of the On The Globe website and mobile app is at their own risk. On The Globe shall not be liable for any damage to computer systems or loss of data resulting from the use of the website or app. The User is prohibited from altering, duplicating, distributing, transmitting, reproducing, publishing, licensing, or selling any information, software, products, or services acquired from the website or app.
User Responsibilities
On The Globe is responsible only for transactions conducted by the User through On The Globe. On The Globe shall not be responsible for screening, censoring, or controlling transactions, including their legality and validity.
Insurance
Unless explicitly provided by On The Globe, obtaining sufficient insurance coverage is the responsibility of the User. On The Globe does not accept any claims arising from scenarios where insurance coverage is not obtained.
Force Majeure Circumstances
The User acknowledges that exceptional circumstances may arise where service providers are unable to honor confirmed bookings due to various reasons. On The Globe shall make reasonable efforts to provide alternatives or refunds in such situations, but shall not be responsible for circumstances beyond its control.
Limitation of Liability
On The Globe shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use or performance of its websites or services.
Feedback and Solicitation
On The Globe may contact the User with offers on various services through direct mailers, emailers, telephone calls, SMS, or any other medium, unless the User chooses not to be contacted.
Proprietary Rights
The User may use materials provided by On The Globe only as expressly authorized, and shall not copy, transmit, or create derivative works without express authorization.
Visa Obligations
Travel bookings are subject to applicable visa requirements, which are the responsibility of the individual traveler. On The Globe is not liable for any issues arising from visa requirements.
Indemnification
The User agrees to indemnify and hold On The Globe harmless from any losses, liabilities, claims, damages, costs, and expenses arising out of any breach or non-performance by the User.
Right to Refuse
On The Globe reserves the right to refuse any customer order without assigning any reason, and may limit or terminate a User's access to the website for any violation of this Agreement or other terms.
Severability
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable.
Headings
Headings are included for convenience only and shall not affect the interpretation of this Agreement.
Jurisdiction
This Agreement shall be governed by the courts of Mumbai, India.
Responsibilities of User
The User acknowledges that On The Globe acts only as a booking agent and shall not be liable for the services provided by third-party service providers.
Usage of Customer's Holiday Pictures
Customer pictures shared during or after a trip may be used for social media engagement unless the User requests otherwise.
